Information regarding hiring a foreign live-in caregiver to work in Canada

 The Live-in Caregiver Program is designed for those persons who are employed outside the home or works from their home and maintains an office in their home, and requires live-in care for their children who are 14 and under. An elderly person, or a disabled person is also eligible for live-in care.

The Human Resources Centre of Canada may ask that you demonstrate that you have made reasonable efforts to find a Canadian or a foreign worker already in Canada and working as a live-in caregiver, but between jobs.

The "Application For a Foreign Live-in Caregiver", completed by the employer, is kept on an employer file at Human Resources Centre of Canada. The information is transmitted to the Canadian Embassy which represents the country the foreign live-in caregiver comes from. The information provided by the employer is given to the Canadian Embassy to base their assessment of the foreign live-in caregiver on. The information is not given to the foreign live-in caregiver. Therefore, unless the employer or the 3rd party representative provides the foreign live-in caregiver with the information, they will have no knowledge about the family, duties , or expectations.

Three main requirements the foreign live-in caregiver must satisfy to qualify under the program:

bulletSuccessful completion of the equivalent of a Canadian Grade 12 education;
 
bulletAbility to prove they have had twelve months experience as a live-in caregiver, or six months full-time training in a field or occupation related to the job the employer is offering;
 
bulletAbility to speak, read and understand either the English or French language; the caregiver must be able to function independently in a home setting. They must be able to contact emergency services if required and understand labels to give medication.

The foreign live-in caregiver must work on a FULL-TIME basis, in a LIVE-IN position ONLY and MUST NOT WORK FOR MORE THAN ONE EMPLOYER AT A TIME. Outside volunteer work is permitted, but only in a situation where the position is normally filled by volunteers.

Employer's responsibilities to a foreign live-in caregiver includes:

 

bulletproviding acceptable working conditions, reasonable duties, and fair market wages,
 
bulletaccommodations that ensure privacy ( the caregiver must be provided with a private bedroom) and freedom of access to the home.
 
bulletensuring that the worker obtains adequate medical coverage. It is strongly recommended that this be done as soon as the worker arrives in Canada. You can apply for B.C. Medical coverage when the worker arrives. Private coverage will be required for the first three months while the Medical Services Plan application is being processed. Foreign live-in caregivers have the same legal rights as Canadians to fair working conditions and fair treatment from their employers.

ACCOMMODATION/ROOM AND BOARD

Room and Board deductions are $325.00/month maximum.

The foreign live-in caregiver must have a private room.
 

WAITING PERIODS

Waiting periods for individuals to be processed by the Canadian offices overseas vary considerably and are dependant upon work loads in the Embassies. Generally, the processing time from European countries is approximately 3 months, and other countries is up to one year and in some cases longer.

THE HUMAN RESOURCES CENTRE'S RESPONSIBILITY is TO ENSURE THAT THERE IS A LEGITIMATE POSITION AVAILABLE WHICH MEETS THE CRITERIA OF THE FOREIGN LIVE-IN CAREGIVER PROGRAM.

CANADA IMMIGRATION'S RESPONSIBILITY IS TO ENSURE THAT THE FOREIGN LIVE-IN CAREGIVER MEETS THE REQUIREMENTS FOR ENTRANCE TO CANADA.


HIRING A FOREIGN LIVE-IN CAREGIVER PRESENTLY IN CANADA

Hiring a foreign live-in caregiver presently in Canada under the foreign live-in caregiver program involves the same process as recruiting a worker from outside of Canada. An application must be completed and a Confirmation of Offer of Employment will be issued if approved. The foreign live-in caregiver must complete an application for employment authorization and mail it to the Immigration Case Processing Center in Vegreville, Alberta. The foreign live-in caregiver should call 666-2171 to receive an application kit in the mail. The application may take several weeks to process by immigration as processing is now done in Vegreville, Alberta.
 

EXTENSIONS TO OFFERS OF EMPLOYMENT

To extend the caregiver's Employment Authorization, the live-in caregiver must send their application to the Immigration Case Processing Centre in Vegreville, Alberta, prior to the expiration of the Employment Authorization. They may have an application mailed to them by calling (604) 666-2171.

You may be required to provide a written request for extension, to continue the worker's employment. The worker should send this written request with their application for extension.

For both extensions and hiring of those presently in Canada on a Employment Authorization, Immigration will charge a processing fee payable in Canadian currency: money order, travelers cheque, or certified cheque. (Cheques should be made payable to Receiver General for Canada). The new or current employer is encouraged to reimburse the foreign worker the cost of recovery fee for processing of subsequent authorizations.
